1. Acceptance
These general terms of use ("Terms") govern access to and use of the website discus.app and the mobile application Discus (hereinafter "the Service"), published by Amaury Lavoine (Discus), a Canadian sole proprietorship based in Ontario. By creating an account or using the Service, you acknowledge that you have read, understood, and accepted these Terms.
2. Service Description
Discus is a language learning mobile application accompanied by a marketing website. The Service offers:
- learning seven languages (English, Spanish, French, Portuguese, Swahili, German, Italian);
- a conversational AI tutor for oral and written practice;
- a personal lexicon, conjugation exercises, dictation, and spaced repetition;
- partial offline functionality for features that do not require a server connection.
3. Account Creation
Creating an account requires you to be at least13 years old, or the minimum age required by the legislation applicable to your jurisdiction of residence. You agree to provide accurate and up-to-date information. Only one account per person is allowed. You are responsible for the confidentiality of your credentials.
4. Subscription and Payment
The premium features of Discus are accessible through a paid subscription, sold exclusively via in-app purchases from Apple App Store and Google Play.
- The price, duration, and renewal terms are displayed before purchase confirmation.
- The subscription automatically renews at the end of the term unless you disable it at least 24 hours before the end of the current period.
- Management and cancellation can be done from your store settings (Apple ID or Google account).
5. Free Trial
When a free trial is offered, its duration and the conditions for automatic conversion to a paid subscription are specified at purchase. You can disable renewal at any time during the trial period from your store settings.
6. Refunds
Refund requests are governed by ourRefund Policy, which we invite you to review.
7. User Obligations
You agree to:
- use the Service in accordance with applicable law;
- not harass the AI tutor or attempt to obtain illegal, hateful, or inappropriate content through query engineering;
- not circumvent the technical or commercial limitations of the Service (quotas, security, authentication);
- not engage in automated scraping of educational content or AI conversations.
8. Prohibited Uses
It is specifically prohibited to:
- reverse-engineer the Service;
- abuse resources (denial of service, fraud);
- submit illegal, defamatory, child pornography, hateful, or violence-inciting content to the AI;
- resell all or part of the Service to third parties;
- automate the use of the Service without prior written authorization from Amaury Lavoine (Discus).
9. Intellectual Property
Amaury Lavoine (Discus) and/or its rights holders own all intellectual property rights related to the application, the Discus brand, logos, educational content, exercises, source code, and graphic elements.
You retain ownership of your personal entries (vocabulary, notes, written texts, audio recordings). You grant Amaury Lavoine (Discus) a worldwide, non-exclusive, and time-limited license to process these entries solely for the purpose of providing, maintaining, and improving the Service.
10. User-Generated Content
Conversations with the AI tutor may, with your explicit and revocable consent, be used in an anonymized manner to improve the educational quality of the Service. No public sharing of your conversations will occur.
11. AI Disclaimer
The AI tutor is a training tool. It is not intended to replace an official translator, a certified teacher, or a legal, medical, or professional advisor. Its corrections are indicative and may contain errors. Amaury Lavoine (Discus) disclaims any responsibility for the interpretations you may make of its responses in real-world contexts.
12. Third-Party Services
The Service relies on third parties, including Apple App Store, Google Play, Vercel (hosting), Supabase (backend), OpenAI and Anthropic (AI), Resend (email). The terms of use and privacy policies of these third parties apply in parallel to these Terms of Use.
13. Warranty and Disclaimer
The Service is provided “as is”, without any explicit or implicit warranty beyond what is required by applicable law. We do not guarantee any specific educational outcome; progress depends on your investment and practice.
14. Limitation of Liability
To the extent permitted by applicable law, Amaury Lavoine (Discus)' cumulative liability under the Service is limited to theamount you have paidwithin the twelve (12) months preceding the event giving rise to the claim. No limitation applies to cases where the law prohibits limitation (fraud, gross negligence, harm to individuals).
15. Indemnification
You agree to indemnify and hold harmless Amaury Lavoine (Discus), its directors, employees, and partners against any claim, loss, or reasonable expense (including legal fees) resulting from your use of the Service in violation of these Terms of Use or the law.
16. Suspension and Termination
Amaury Lavoine (Discus) may suspend or terminate an account in the event of a violation of these Terms of Use, after notification when possible. You may terminate your account at any time from the app settings or by contacting us. Termination does not entitle you to a prorated refund, subject to the mandatory provisions applicable in your jurisdiction.
17. Changes to the Terms of Use
We may modify these Terms of Use. Significant changes will be notified at least 30 days before they take effect (banner in the app and email to registered users). Your continued use of the Service after this period constitutes acceptance of the new terms. If you do not accept, you may terminate your account at no cost.
18. Governing Law
These Terms of Use are governed by the laws of the Province of Ontario, Canada, as well as applicable federal Canadian laws, without regard to conflict of law rules. The mandatory consumer protection provisions of your residence jurisdiction remain applicable when they are more favorable to you.
19. Jurisdiction
Any dispute arising from the execution or interpretation of these Terms of Use shall, in the absence of prior amicable resolution, be submitted to the exclusive jurisdiction of the courts of the Province of Ontario. A prior amicable arbitration clause may be agreed upon between the parties if necessary.
20. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable by a competent jurisdiction, the other provisions shall remain fully applicable.
21. Entire Agreement
These Terms of Use, the Privacy Policy, the Cookie Policy, and the Refund Policy constitute the entire agreement between you and Amaury Lavoine (Discus) regarding the Service. They replace any prior agreement or communication regarding the same subject.
